I saw your segment on Steve Bannon's WarRoom where you outlined these arguments. What I do not understand is, why do you recommend dismissing the indictment without prejudice? This indictment should be dismissed with prejudice. It's an obvious political hit job coordinated with the DOJ and White House. There is absolutely no merit to the case, especially with all the recent revelations about vote and voter irregularities in Georgia. If the case is dismissed without prejudice, the democrats will just find some other disreputable hack to start again and continue to tie Trump in court over bogus charges. What is your reason for saying "without prejudice" rather than "with prejudice?"

It seems important to know the Appointments Clause in Georgia’s Constitution. It seems that an Attorney General does not have the authority to appoint a Special Prosecutor, but that the power would be vested in the Governor and the Legislature. Ed Meese, AG under Reagan recently filed an amici brief with SCOTUS bringing to light Jack Smith’s lacking the authority as Special Prosecutor due to not meeting the requirements of the Appointments Clause at the Executive nor Representative levels. Meese did not file alone.

A Motion to Dismiss will wipe out this case, with or without prejudice.

Governor Kemp is not going to do anything unless forced to. He's on the same side as Willis and the Democrats.

Unfortunately, it looks like Georgia has a corrupt election system that will keep Kemp in place (and I'm starting to think that Stacey Abrams might have had a point) and keep Trump from winning the state. Again.
